1. Information We Collect
When you request marketing, technical, or product information related to the Services, register to use the Services, or attend an event hosted by us, we collect your name, your employer’s name, title, phone number, and email address. When you use our Services, we also ask you to provide additional information, such as login credentials, other cloud services you use, monthly cloud computing spend, and your industry. If you apply for a job with us, we will collect your resume or curriculum vitae.
Through our “add users” feature option in our Services, we also collect personal contact information such as the name, company name, address, phone number, and email address of the individuals that you choose to share with us. When you provide us with personal contact information about new users, we will only use this information to add and enable new users to your account. By providing us with this information, you agree that you have the legal authority to transfer the personal information to us in the United States.
We may also acquire personal information about you through third-party data brokers.
If you participate in community blogs or commenting features on our websites, we will collect your contact information and the other information you submit. This information, including your contact information, may be viewed by others who visit these forums. We are not responsible for the personal information you choose to submit in these forums and may delete or correct it at any time.
We collect your billing information in connection with credit card payments initiated by you.
2. How We Use Information Collected
How we use your personal data will depend on the Services you use, how you use those Services, and the choices you make in your settings. We use the data that we have about you to provide, support, and personalize the Services, and make the Services more relevant and useful to you and others.

For example, RightScale may use your personal information to contact you to further discuss your interest in the Services or promote engagement with our Services. You may review and change the types and frequency of emails you receive from us or opt out of receiving all emails by visiting our Email Preference Center.
If you pay us for Services by credit card, we use your billing and credit card information solely to check your financial qualifications and collect payment from you.

Our websites may use social media features, such as the Facebook “like” button. These features may collect some information about your use of our website. You may be given the option by social media providers to post information about your activities on our website to your profile page or on our site.
Do Not Track
Currently, various browsers — including Chrome, Firefox, and Internet Explorer, and Safari — offer a “do not track” or “DNT” option that relies on a technology known as a DNT header, which sends a signal to websites visited by you about your browser DNT preference setting. We do not currently commit to responding to browsers' DNT signals with respect to our websites, in part, because no common industry standard for DNT has been adopted by industry groups, technology companies, or regulators, including no consistent standard of interpreting user intent. We will continue to monitor developments around DNT browser technology and the implementation of a standard.
3. How We Share Information We Collect
We do not share, sell, rent, or trade any of your personal information with third parties except as described in this Privacy Statement.
We may share your personal information with online advertisers for the purpose of providing email or other display ads to you about our Services and events. You can opt out of the advertising by emailing us at email@example.com.
We share your personal information with service providers to enable our service providers to provide you with services on our behalf. We contractually restrict our service providers to use your personal information only as necessary to provide services to us.
We share information within our corporate family. For example, we may need to share your personal information with one of our subsidiaries in order to provide you with technical support or account management purposes in your region.
We may partner with other companies, such as our cloud provider partners, to jointly offer products, services, or programs (such as webinars or downloadable content). If you purchase, specifically express interest in, or register for a jointly offered product, service, or program from or through us, we may share your personal information with our partner.
We will also share information with our partners and event sponsors if you specifically opt in to such sharing via an event registration form or attend an event and allow us or our partners to scan your attendee badge.
We do not control our partners’ use of your personal information. If you do not wish for your personal information to be shared in this manner, you may opt not to purchase or specifically express interest in a jointly offered product or service.
RightScale uses a third-party service provider to manage credit card processing for our Services. Our service provider is contractually prohibited to store, retain, or use your billing information except for the sole purpose of credit card processing on our behalf.
It is possible that we will need to disclose information about you when required by law, subpoena, or other legal process or if we have a good faith belief that disclosure is reasonably necessary to (1) investigate, prevent, or take action regarding suspected or actual illegal activities or to assist government enforcement agencies; (2) enforce our agreements with you, (3) investigate and defend ourselves against any third-party claims or allegations, and (4) protect the security or integrity of our products and services (such as by sharing with companies facing similar threats). We attempt to notify customers about legal demands for their personal data when appropriate in our judgment, unless prohibited by law or court order or when the request is an emergency. We may dispute such demands when we believe, in our discretion, that the requests are overbroad, vague or lack proper authority, but we do not promise to challenge every demand.
Change of Control
We can also share your personal data as part of a sale, merger, or change in control, or in preparation for any of these events. Any other entity which acquires us or part of our business will have the right to continue to use your data, but only in the manner set out in this Privacy Statement unless you agree otherwise.
4. Children's Privacy
Our websites and marketing are not directed to children under 13 years of age. We do not intentionally gather information about visitors who are under the age of 13. If our practice changes, we will obtain consent from a parent or guardian before we knowingly collect PII from anyone under the age of 13.

We primarily store your information in the United States. To facilitate our global operations, we may transfer and access such information worldwide, including from other countries in which we have operations.

Model Clauses, also known as Standard Contractual Clauses. 6. Correcting and Updating Your Personal Information; Changing Your Preferences
We may retain your personal information for a period of time consistent with the original purpose of collection. For instance, we may retain your personal information during the time in which you have an account to use our websites or Services and for a reasonable period of time afterward. We also may retain your personal information for as long as we need it to conduct audits, comply with our legal obligations, resolve disputes, and enforce our agreements.
You may request to review, correct, delete, or otherwise modify any of the personal information that you have previously provided to us.
